PARTY RENTAL TERMS AND CONDITIONS

1. Equipment Care, Damage, and Liability

The Customer acknowledges receipt of the rented equipment (the "Material") in good, clean, and working condition. The Customer assumes full responsibility for the care, custody, control, and safekeeping of all Material from the time of delivery/setup until the time of pickup by the Company.

Any damage, destruction, alteration, or loss caused to the Material while in the Customer's possession must be paid for by the Customer. The Customer agrees to pay the full repair costs or the current retail replacement value of the Material if it is damaged beyond repair, missing, or permanently stained.

2. Safety Rules, Proper Use, and Liability Waiver

The Customer agrees to strictly follow all operating instructions, warning labels, and safety rules provided with the Material (including, but not limited to, weight limits, capacity rules, and weather restrictions).

Assumption of Risk: The Customer acknowledges that the use of rental equipment involves inherent risks of injury. The Customer voluntarily assumes all risk of injury, loss, or damage to person or property arising out of the use, operation, or possession of the Material.

Hold Harmless: The Customer agrees to defend, indemnify, and hold harmless the Company, its owners, and employees from any and all claims, lawsuits, damages, or injuries (including severe bodily injury or property damage) arising out of or connected to the rental, setup, use, or presence of the Material at the event location.

Termination: Failure to follow safety rules constitutes a major breach of this agreement. The Company reserves the right to immediately terminate the rental and remove the Material without a refund.

3. Overnight Rentals, Severe Weather, and Theft

At the discretion of the Company, Material may be left overnight at the Customer's designated location. The Customer remains fully liable for the Material 24/7 until it is safely back in the Company's possession.

Security: The Customer must ensure the setup area is secure and protected from theft, vandalism, pests, and severe weather.

Weather Policy: The Company reserves the right to deny setup, modify operations, or terminate a rental early if weather conditions (including but not limited to winds exceeding 15 mph, lightning, heavy rain, or extreme heat) pose a risk to safety or the Material. No refunds will be issued for weather-related early terminations.

Loss/Theft: If any part of the Material is stolen, vandalized, or missing upon pickup, the Customer is legally and financially responsible and agrees to pay the full retail replacement value within 7 business days.

4. Multi-Day Rentals, Timing, and Extended Fees

Standard rentals are for the agreed-upon timeframe specified in the booking invoice.

Extra fees apply for every additional day or hour the equipment is kept.

Extended rentals must be approved in writing by the Company prior to the scheduled pickup time. Unapproved delays or failure to grant the Company access to the property for pickup at the scheduled time will result in an automatic unauthorized late fee equal to a full day's rental rate per day.

5. Pricing, Location Surcharges, and Same-Day Bookings

All prices displayed on the Company website are base rates. Final pricing is calculated on the booking invoice and is subject to change based on the delivery zip code.

Additional charges—including but not limited to delivery fees, difficult setup terrain fees, distance surcharges, and local taxes—will be itemized on the final quote.

Same-Day Orders: Bookings requested for the same calendar day are subject to a Same-Day Expedited Fee to cover urgent scheduling, inventory prep, and route adjustments. This fee will be calculated and added to the final invoice before delivery.

6. Non-Refundable Booking Fee & Cancellation Policy

To officially reserve the Material and secure your event date, a non-refundable Booking Fee (Retainer)equal to [Insert Percentage, e.g., 25% or 50%] of the total invoice is required at the time of booking.

Non-Refundable: All booking fees are strictly non-refundable. Reserving Material removes it from active inventory, making it unavailable to other potential clients.

Cancellation Notice: Cancellations made fewer than [Insert Days, e.g., 7 or 14] days prior to the event date will result in the forfeiture of the entire balance. If cancelled prior to this window, any balance paid beyond the initial booking fee may be issued as a company credit for a future rental within 1 year.

7. Delivery vs. Setup Services

Unless explicitly stated otherwise on the booking invoice, standard delivery consists of a strictly curbside or driveway drop-off of the Material at the designated address.

Customer Responsibility: By default, the Customer is solely responsible for moving, assembling, inflating, positioning, and anchoring the Material safely at the event site.

Optional Company Setup: If the Customer requires the Company to handle the physical setup, arrangement, or teardown of the equipment, this service must be requested in advance and will be subject to an additional Setup/Teardown Service Fee itemized on the final invoice. The Company will not perform setup services on-site unless this fee has been paid.

8. Governing Law and Severability

This Agreement shall be governed by and construed in accordance with the laws of the State of Arizona, with venue restricted exclusively to courts located in Maricopa County. If any provision of this agreement is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
